Disclosure is the law, not a courtesy
In the UK, the ASA and CMA expect paid and gifted content to be clearly labelled as advertising. The UK's DMCC Act gave the CMA power to fine businesses up to 10% of global turnover for consumer law breaches from April 2025 (Cooley on the DMCC Act, April 2025). In the US, the FTC's 2024 rule bans fake reviews and the buying of fake followers or views (US FTC, Aug 2024). In the UAE, an Advertiser Permit from the UAE Media Council became mandatory for influencers and content creators from 1 February 2026 (Middle East Briefing). Financial products carry extra rules: the FCA warns that unauthorised influencers promoting regulated products may commit a criminal offence (FCA FG24/1), and SEBI bars regulated entities from associating with unregistered finfluencers (Business Today, Aug 2024).
